Эротический журнал судится с "Яндексом" - The American erotic magazine has legal proceedings with "Yandex"

Издатель американского эротического журнала Perfect 10, которому к тому же принадлежит одноименный сайт "для взрослых", просит суд вызвать гендиректора отечественной компании "Яндекс" на допрос в рамках рассмотрения иска о нарушении авторских прав, поданного журналом в калифорнийский суд к зарегистрированной в Нидерландах компании Yandex N.V., передает РИА "Вести".



Компания Perfect 10, по ее своему признанию, была вынуждена свернуть издание популярного журнала, составлявшего конкуренцию Playboy, из-за "безудержного нарушения прав". Сегодня компания занимается производством и распространением разнообразного интернет-контента для взрослых вплоть до мобильных приложений. Раньше издатель уже пытался привлечь к ответственности владельцев RAPIDSHARE за распространение ч/з их файлообменный сервис материалов журнала, однако потерпел неудачу. Perfect 10 обратился в американский суд в итоге мар., заявив о нарушении принадлежащих ему авторских прав с позиции ответчика - голландской Yandex N.V., имеющей статус материнской компании русского "Яндекса". В исковом заявлении указывалось, что на Yandex N.V. зарегистрированы доменные имена yandex.com, yandex.ru, yandex.st, yandex.net под проекты, которые "в свободном доступе предлагают то, что на сегодня составляет основу бизнеса Perfect 10". Сейчас истец потребовал допросить в суде генерального директора русского "Яндекса" Аркадия Воложа и директора компании по технологии и создании Илью Сегаловича. В собственную очередь ответчик просит отказать истцу в вызове таких очевидцев, так как не видит в этом смысла. В документе отмечается, что ни Волож, ни Сегалович не знают по существу дела ничего, чего не имели возможность бы поведать иные сотрудники компании. При этом обязательство явиться в суд будет для них довольно обременительным, так как они проживают в РФ. В итоге в случае вызова в суд им будет нужно пересечь полмира, значительно изменив собственный рабочий график. В то же время представители ответчика указали, что готовы обеспечить явку в суд 4-х пребывающих в США работников, любой из которых свободно заявляет по-английски и может дать исчерпывающие показания по сути дела. Раньше Yandex N.V. подала в суд ходатайство об отклонении иска. По заключению компании, спор неподсуден американскому суду. Так, член совета директоров Yandex N.V. в приложенном к ходатайству заявлению подчеркнула голландское происхождение Yandex N.V., и то, что у компании нет никакого бизнеса, активов и даже работников в Калифорнии. До недавних пор кое-какие операции в США производила русская Yandex LLC, хотя несколько лет тому назад ее функции взяла на себя зарегистрированная в Делавэре Yandex Inc. По заявлению Иващенцевой, эта компания набирает в Кремниевой долине специалистов по программному обеспечению. При этом это самостоятельная структура, с своей финансовой отчетностью и счетами.
