Женщина-фотограф подала в суд на Apple из-за незаконного использования глаза - The woman-photographer has brought an action on Apple because of illegal use of an eye

Фотограф из Швейцарии Сабине Ливальд подала в суд на компанию Apple за "неправомерное использование" ее работы в рекламе ноутбука MacBook Pro с дисплеем Retina. На снимке, о котором идет речь, изображен крупным планом женский глаз с необычным макияжем. Фотографию, по словам женщины, "яблочная" компания приобрела у нее через фотоагентство Factory Downtown. Однако, согласно договору, Apple имела право использовать фотографию лишь в качестве макета, но не в рекламе.



   Компания же, как сказано в иске, добавила к снимку интерфейс Adobe Photoshop, продемонстрировала результат на WWDC 2012, да еще и поместила ее на свой сайт в раздел MacBook Pro, сообщает CNet News. Теперь Сабине Ливальд требует, чтобы Apple выплатила ей компенсацию и отдала часть прибыли, которая была выручена компанией. Примечательно, что сразу после этого компания вырезала фотографию глаза, права на которую принадлежит Ливальд, и заменила ее на другой глаз с макияжем попроще. Пока что сложно сказать, удастся ли адвокатам потерпевшей доказать, что компания Apple выручила хоть какую-то прибыль, благодаря фотографии, сделанной Сабине Ливальд, но если удастся - женщина-фотограф вполне может готовиться к роли миллионера. 

The photographer from Switzerland Sabine Livald has brought an action against company Apple for "misuse" of its work in advertising of laptop MacBook Pro with display Retina. In a picture about which there is a speech, the female eye with an unusual make-up is represented by close up. Photo, according to the woman, the "apple" company has got at it through photoagency Factory Downtown. However, according to the contract, Apple had the right to use a photo only as a breadboard model, but not in advertising. The company as it is told in the claim, has added interface Adobe Photoshop to a picture, has shown result on WWDC 2012, moreover and has placed it on the site in section MacBook Pro, informs CNet News. Now Sabine Livald demands, that Apple has paid it indemnification and has given a part of profit which has been obtained by the company. It is remarkable that right after it the company cut out a photo of an eye the rights Livald on which belongs, and has replaced it with other eye with a make-up easier. It is meanwhile difficult to tell, whether it will be possible to lawyers suffered to prove that company Apple has gained though any profit, thanks to a photo, Livald made Sabine but if it will be possible - the woman-photographer can quite prepare for a role of the millionaire.
